Wedding Photography Terms and Conditions
In the following terms & conditions “the photographer” shall mean Joe Topping trading as ‘Joe Topping Photography’. “The client(s)” shall be those persons defined as bride and groom in the wedding booking. It is agreed that the following terms set out the total agreement made between the parties and that no variation or modification of this contract shall be effective unless agreed by both parties in writing.
Photographer reserves the right to use images created under this contract for advertising, display, publication or other purposes. The Client signing this contract gives permission for Photographer to use their name, images and photographic likeness in advertising, display, publication or other purposes. Negatives, digital files, websites and previews remain the exclusive property of Joe Topping Photography.
Waiver of Liability:
The Client expressly releases Photographer, their employees and agents from all claims, damages, and liabilities that may result from accidents or incidents that occur while services are being performed or thereafter. This waiver of liability includes waiver of any claim that may be a result of negligence.
If Photographer cannot perform this Agreement in whole or in part due to a fire or other casualty, acts of God or nature or terror, or other cause beyond the control of the parties or due to Photographer’s illness or injury, then Photographer will return all fees to the Client(s) but shall have no further liability with respect to this Agreement. This limitation on liability shall also apply in the event that photographic materials are lost or damaged. Client(s) agree that an entire wedding cannot be replicated, re-enacted or repeated for the purpose of a re-shoot and limits photographer’s liability to the amount paid under this contract. All disputes arising out of or in connection with the present contract shall be finally settled in Arbitration.
It is understood and agreed that Photographer will be the exclusive official photographer and others taking photographs at the wedding will be permitted only at our discretion. Client will advise guests and other individuals to refrain from using flash photography at any point during the ceremony and other important events of the day.
Photographer does not guarantee any specific poses and/or effects, but will produce photographs that timing, lighting, weather, building characteristics, venue rules, interference from other cameras, and wedding participant/attendee cooperation permits.
All image will be inspected individually, culled and enhanced by me personally (enhancements include global adjustments to brightness, contrast, colour, cropping and similar). Manipulation by means of retouching (adding, removing or swapping parts of an image) is available at an additional cost.
On signing of this agreement by both parties hereto, Photographer will reserve the time agreed upon and will not make another reservation for the specific time frame. For this reason, all deposits are non-refundable if the date is changed or if the wedding becomes cancelled for any reason.
A booking fee of 25% is due at the signing of this agreement, with a further payment of all balances paid no later than 30 days prior to the wedding date. No photography will take place and no rights are granted until a timely deposit is made in full. Returned check fees apply.
The Client may cancel this contract at any time by giving written notice to The Photographer/s but in doing so shall forfeit any monies paid. Cancellation less than 12 weeks before the wedding will result in the payment in full becoming due. All cancellations must be in writing. By paying this deposit you also accept the terms and conditions.
